LEGAL TERMS AND CONDITIONS  

This notice contains the legal terms and conditions governing the website www.venicemart.com. By accessing the site, users agree to accept and abide by all conditions contained in this statement. EROSE SRL reserves the right to ask Users who do not accept or do not intend to comply with these terms to refrain from using the website. Access to the site and related services is intended exclusively for personal use. The site is owned by EROSE SRL. At any time, EROSE SRL may modify the contents of the site, including the commercial conditions expressed therein, without having to provide any notice. EROSE SRL disclaims any responsibility regarding the possibility that, due to a particular configuration of the computer used by the Customer or its malfunction, the colors of the products displayed on the site may present slight differences compared to the original ones.  

SALES CONDITIONS  

The sale of products contained in the virtual catalogs on this site is regulated by the following General Conditions of Sale formulated in compliance with the regulations on contracts concluded outside commercial premises. The sales contract can be concluded in the following languages: Italian and English.  

CONTRACTING PARTIES  

The purchase and sale agreement shall be deemed to be between:

- EROSE SRL with registered office at Via Zandonai 10, Venice - Italy, VAT and Business Register registration 04663850271, registration at the R.E.A. of the C.C.I.A.A. number VE-438450

- Customer: the person (natural or legal person) who, through the site, has transmitted an order that has been accepted by EROSE SRL.

The application of any other contractual conditions is excluded, even if not expressly disavowed by EROSE SRL.

APPLICATION OF THE GENERAL CONDITIONS OF SALE  

Before making a purchase, the Customer is invited to carefully read these General Conditions and is authorized to store, reproduce, download a copy and/or print them. For any further information, the Customer is invited to contact the website's customer service at shop@venicemart.com. By completing the formalities required to place a purchase order, the Customer declares to have read and to fully accept the General Conditions of Sale. The general conditions of sale may be modified over time by EROSE SRL, and any modifications will become valid with publication on the site. Each contract will be subject to the conditions in force at the time of purchase.

CHARACTERISTICS OF THE SERVICE

DESCRIPTION OF PRODUCT SALES  

The service for the sale of Products activated on the Site includes registration, access to selections, choice of Products, online transmission of the purchase order, and possible online acceptance of the purchase order.  

Registration:  

Purchase and/or registration implies acceptance of the above-mentioned General Conditions that govern the contract for the supply of Products, as well as consent to the processing of personal data. In case of registration, the Customer is required to keep the password with the utmost diligence, committing not to allow the use of the service by third parties not expressly authorized by them, for whose behavior online they assume all responsibility. In case of loss, theft, or loss of the password, the Customer will have the right to activate the procedure for issuing a new password available on the Site. If the customer wishes to cancel their account, they must send such a request to the Customer Service email address.  

Purchase Order:  

Each purchase order received by EROSE SRL must clearly indicate the Product code, its description, quantity, address, and name of the recipient. The ordering procedure on the Site provides the possibility to identify and correct data entry errors before submitting the purchase order. The purchase order sent by the Customer constitutes a binding contractual proposal for the Customer. To confirm receipt of the order, EROSE SRL will send the Customer a summary email to the email address indicated in the registration. This email is for informational purposes only and does not constitute acceptance by EROSE SRL of the order itself.

Acceptance of the Purchase Order and Conclusion of the Sale Contract:  

EROSE SRL reserves the unquestionable right to accept or not the purchase order submitted by the Customer. EROSE SRL, subject to what is provided in the following paragraph, undertakes to process the Customer's order or to notify them of any issues, without delay and in any case no later than 7 days from the day following the day on which the Customer transmitted the order. It is understood that the execution of the order is subject to the actual availability of the Products. In case of unavailability of the Product and/or in case of non-acceptance of the order, EROSE SRL will promptly inform the Customer and reimburse them if payment has already been made. In this case, the Customer will not be entitled to any other compensation or reimbursement.

Orders transmitted by individuals who have not reached the age of majority will not be accepted.

Method of Archiving the Sales Contract:  

The sales contract will be archived on the Site and the Customer can access it at any time by following the viewing procedure on the Site.

PRODUCT CHARACTERISTICS

The Products are depicted in the online Catalog in such a way as to correspond, as much as possible, to the exact characteristics they possess. The published images, having the value of general informational material, may not exactly correspond to reality. The Products depicted in the online Catalog may be purchased until stocks are exhausted, without prejudice to EROSE SRL's right to make certain Products unavailable at any time and/or to modify their characteristics. EROSE SRL also reserves the right to update the online Catalog at any time, modifying the range or number of products.

PRICES AND CURRENCY  

The price of the Products is that resulting from the Price List published on the Site and in force at the time of transmission of the order by the Customer. The prices of the Products published on the Site are inclusive of standard packaging and/or wrapping and VAT (except for countries outside the EU), whose rate is determined in relation to the type of Product and the country of destination. Prices do not include transport and delivery costs. All the aforementioned costs (of delivery and special packaging/wrapping), not included in the prices of the Products published on the Site, will be separately indicated in the order summary and confirmed in the order acceptance email that will be transmitted to the customer by EROSE SRL. Furthermore, for deliveries to be made in EU States other than Italy and in Other States, to Campione d'Italia, Livigno, Channel Islands, and Canary Islands, the prices of the Products published on the website are always understood to not include:

- any taxes and/or sales taxes.

- any customs duties and/or charges.

- any other applicable tax and/or charge for the delivery of ordered Products.

The Customer will be required to pay all customs duties and charges applicable in the country of delivery of the ordered Products. Each and every charge or cost related to the customs clearance of the delivered Products will remain the exclusive competence of the recipient of the delivery. Orders are invoiced in the currency related to our sales price list of the country to which you wish to ship. The amount that will be charged to the credit card may vary because it is based on fluctuating exchange rates and bank commissions. Customers are invited to contact their banking institution to request detailed information on exchange rates and bank commissions related to their transaction.

PAYMENT METHOD

PAYMENT BY CREDIT CARD

Payment by credit card of enabled circuits must be made online, at the time of transmission of the purchase order. The Customer will be required to provide the details of their credit card in the purchase order, and the request to charge the corresponding amount will be forwarded only when the order is completed. The Customer's credit card data sent during the transmission of the purchase order is not accessible either to EROSE SRL or to third parties and is received, in a manner protected against unauthorized access, on the secure servers of Shopify Payments, which handles credit card payments on behalf of EROSE SRL. When EROSE SRL receives confirmation of the payment, it will proceed with the preparation and fulfillment of the purchase order. Credit Card Security:  

Since all transactions are processed by Shopify Payments, Customers are guaranteed maximum security on purchases. Customer Service operators are not in any way authorized to request or accept credit card numbers and/or validity details.

RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from the Contract, exercisable within 14 days of receiving the purchased goods. The return must be made according to our procedure with delivery to the following address: Venice M'Art Shop, Cannaregio 5631, 30121 Venice (VE), Italy. The Customer must return, at their own care and risk, to the address indicated above, the purchased Products, intact and complete (including the original packaging of the item), within and not later than 14 days from the receipt of the purchased Products. For the sole purpose of the expiration of the aforementioned 14-day period, the Products are considered returned when they have been delivered to the carrier. The withdrawal is exercisable for the entire purchased Product and therefore cannot be operated in relation only to a part of the ordered merchandise.

Alternatively, the Customer can independently ship the purchased products to the address indicated above with the shipping company of their preference.  

Conditions:

- Products must not have been worn, washed, or altered and must not show any signs of use.

- Each Product must be returned including all original labels, packaging, and accessories received with the order. Products must be returned with their original box, which is considered in all respects an integral part of the product itself and which must not have been damaged and/or altered in any way.

- In the event that the Customer receives defective merchandise, or that shipping errors occur on the part of EROSE SRL, it is required to follow the same instructions reported above (return). EROSE SRL reserves the right to request photographic evidence before authorizing returns for defective merchandise and to bear the shipping costs for the return of the merchandise to its premises.

- Swimwear and intimate apparel (Bikinis, briefs, boxers, etc.) must be tried on over one's personal underwear. Returns of such items will be refused and returned to the Customer if the transparent hygienic protection label has been removed, or if the items show signs of use.

- All returned Products are subject to inspection and must comply with all parameters listed in the return procedure.

- EROSE SRL reserves the right to refuse returns not authorized by customer service. Authorization must be requested via email to the customer service address.

- Withdrawal is not allowed for personalized products.

- The return must be delivered to the courier already packaged in such a way as to allow transport without damaging the items inside.

At the time of verification of the integrity of the product (as per the General Contract Conditions), the cost of the item(s) will be refunded while the shipping costs incurred for shipping the return will be retained by EROSE SRL.

In all cases where the withdrawal is not legitimately and validly exercised by the Customer, EROSE SRL will return the Product to the Customer, at the risk and expense of the latter; the Customer must also take care of the organization for the return of the goods. In the event that the returned Products are damaged during transport for redelivery to EROSE SRL, the Customer will be informed of the damages detected by the third working day from receipt of the Products, in order to allow the Customer to inform the carrier in turn and assert their reasons against the latter and, at the same time, will return to the Customer the Products damaged during transport, at the risk and expense of the Customer. In the event that the withdrawal is exercised in accordance with the provisions of current regulations, EROSE SRL will refund the amounts paid by the Customer.

The refund of accepted returns will take place as soon as possible and in any case within fourteen days from the date on which EROSE SRL has received confirmation from its warehouse of the arrival and acceptance of the return. EROSE SRL will not give notice of delivery of the return to its warehouses by the courier; the customer can personally inquire about the delivery through the shipper to whom the return shipment was entrusted. The customer will receive a notification email confirming the refund by EROSE SRL within the 14 days provided. EROSE SRL is not responsible for the timing of crediting the refunded amount, which is totally regulated by the companies issuing the credit cards used.

The Site and all its content is the property of EROSE SRL. This includes documentation, images, characters, design, music, software, codes, and format scripts. The material contained on the website is protected by copyright. Any reproduction, alteration, transmission, publication, or redistribution to third parties, for commercial purposes, is strictly prohibited if it lacks express written consent provided by EROSE SRL. EROSE SRL prohibits the use of the content or brands present on the site for any purpose other than those mentioned above. The images contained on the site are the property of EROSE SRL. Any use of such images, unauthorized by written consent from EROSE SRL, will be prosecuted according to the law.
